The foregoing person ("Tenant") agrees to lease the premises known as The Sahara House located in Twentynine Palms, CA 92277("Premises") from Joshua Tree Vacation Homes ("JTVH"), upon the following terms and conditions:
1. TERM: Two Nights Three Nights Four Nights Five Nights Six Nights Seven Nights Eight Nights+ commencing on January February March April May June July August September October November December 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 2008 2009 2010 2011 2012 2013 at 4 p.m.
and ending on January February March April May June July August September October November December 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 2008 2009 2010 2011 2012 2013 at 11am.
2. OCCUPANTS: Tenant declares 1 2 3 4 5 6 occupants for the term of the rental. Undeclared guests will result in an additional fee of $50.00 per person per day. If you are staying as a group of more than 6 occupants, please contact JTVH so we can make additional preparations.
3. PETS: Tenant declares 0 1 2 3+ dogs for the term of the rental. All pets must be well behaved and house trained. If your pet will be staying with you, a pet cleaning fee of $25.00 is required. Undeclared pets will result in an additional fee of $50.00 per pet per day.
4. DEPOSIT: Tenant shall pay deposit of 50% of rents payable at time of booking. Deposit will be paid by credit card. Use your credit card at PayPal.com to pay your deposit and/or your final payment balance.
5. RENT: Tenant shall pay as rent for the use of the Premises during the Term the
sum of See pricing structure on the rates page or contact JTVH for amount. Final payment is due in advance to JTVH no later than 30 days prior to scheduled arrival.
6. CANCELLATION: Tenant may receive a full refund if cancellation is made 30 days or more prior to scheduled arrival. Cancellations made within 30 days of arrival will receive 50% refund.
7. DAMAGES/THEFT: Tenant agrees to pay for any damages made to premises by neglect or mischievous acts. Any theft or damages will be charged to your credit card. As a condition of JTVH's agreement to lease said Premises, Tenant agrees to execute the release and waiver contained as follows:
Upon execution of this Rental & Release Agreement ("Agreement") by all or both parties (as applicable), Tenant hereby releases and forever discharges JTVH and JTVH's heirs, assigns, beneficiaries, employees, and agents from any and all claims, demands, liabilities, obligations, causes of action, loss, damage or injury whatsoever, whether known or unknown, suspected or unsuspected, arising out of and/or in connection with this Agreement and/or Tenant's use and rental of the Premises. Tenant hereby assumes all liability for and will hold JTVH harmless from and against any and all claims, demands, liabilities, obligations, causes of action, loss, damage or injury whatsoever, whether known or unknown, suspected or unsuspected, claimed by any guest or invitee of Tenant's upon the Premises during the Term. It is the intention of the parties that the release shall be effective as a bar to each and every claim, demand and cause of action concerning the rental of the Premises, including, without limitation, any injury to Tenant, Tenant's guests and invitees and Tenant's property occurring as a result of Tenant's rental and/or use of the Premises. In the event that the Premises sustains any property damage and/or in the event that anything is taken from the Premises during the Term, Tenant shall be fully liable for the cost to JTVH to repair or replace any such property, as applicable, and Tenant will be notified and JTVH shall be authorized to charge Tenant's credit card for said amount.
