Conditions of Use

In accordance with local guidelines and vacation rental home license, the guest is notified and agrees to provide their name, address, contact number, and driver's license and/or passport number. A photocopy of the booking’s responsible adult occupant may be requested unless otherwise verified.

• Agree to check-in times no earlier than 4:00 PM and check-out by 11:00 AM unless pre-arranged.
• Will not exceed the maximum number of six occupants permitted and notification that failure to conform to the maximum occupancy is a violation of the City of 29 Palms Development Code.
• Allow no undeclared occupants, children, or visitors. Unauthorized guests and visitors are subject to a $75.00 per person charge which may result in immediate termination of the rental agreement and expulsion from the property without refund.
• Use dedicated off-street parking, in the driveway and/or garage. No overnight street parking.
• Respect the quiet enjoyment of neighboring properties. Conform to Noise Control Ordinances and Quiet Hours of 10:00 PM-7:00 AM
• Guest acknowledges the presence of a noise alert monitoring device in order to ensure that neighborhood noise levels are respected. The device cannot record actual sounds or conversations but may contact guests via text when decibel readings outside of guidelines are reached.
• Accept no animals policy.
• Acknowledge that parking/entry point security cameras may be in place for guest safety, property security, and compliance with house rules.
• Understand the security deposit is fully refundable upon return of the home without damage, theft, unauthorized guests, pets, or claims.
•  Agree to use proper garbage containers for the purpose of disposal. Guests are asked to return trash bins to the home within 24 hours of collection day.

Terms

The Guest may not create unreasonable noise or disturbances, engage in disorderly conduct, or violate provisions of the Municipal Code or any State Law pertaining to noise, disorderly conduct, overcrowding, the consumption of alcohol, or the use of illegal drugs. The Guest may be cited for violating applicable ordinances and laws and may be subject to citation and fines for violation(s). The Owners shall take measures necessary to abate disturbances, including, but not limited to, directing the tenant, calling for law enforcement services, or City code enforcement officers, eviction, or any other action necessary to immediately abate the disturbance. Guest hereby releases and forever discharges Owner, owners heirs, assigns, beneficiaries, employees, and agents from any and all claims, demands, liabilities, obligations, causes of action, loss, damage or injury whatsoever, whether known or unknown, suspected or unsuspected, arising out of and/or in connection with this Agreement and/or Guest’s use and rental of the Premises.

Guest hereby assumes all liability for and will hold Owner harmless from and against any and all claims, demands, liabilities, obligations, causes of action, loss, damage or injury whatsoever, whether known or unknown, suspected or unsuspected, claimed by any guest or invitee of Guest upon the Premises during the Term. It is the intention of the parties that the release shall be effective as a bar to each and every claim, demand, and cause of action concerning the rental of the Premises, including, without limitation, any injury to Guest, Guests and invitees and Guest’s property occurring as a result of Guest rental and/or use of the Premises. In the event of undeclared visitors or pets, that the Premises sustains any property damage and/or in the event that anything is taken from the Premises during the Term, Guest shall be fully liable for the cost to Owner to repair or replace any such property, as applicable, and Guest will be notified and Owner shall be authorized to withhold expense from Tenant’s deposit for said amount.
